Justice Srem Sai celebrates Tsatsu Tsikata’s career and highlights landmark Akpeteshie case

The Deputy Attorney General, Justice Srem Sai, has shared a Facebook post following the UPSA Law School honourific lecture and awards ceremony held on Wednesday, 15 April 2026, which was themed “Celebrating the Lifetime Achievements of Lawyer Tsatsu Tsikata.”

In the post, he paid tribute to Tsatsu Tsikata, describing him as a mentor’s mentor who also mentors him, and noted that Tsikata has handled many controversial and landmark cases over his 51 years at the bar.

He highlighted what he described as one of the most “colourful” cases in Tsikata’s career, the case The Proprietor; Mok Beer Bar v. Gada [1979] GLR 35, in which Tsikata acted as lawyer for the buyers.

According to him, the case took place at a blue kiosk at Zongo Lane in Accra in December 1974, about two weeks to Christmas.

He explained that the buyer purchased two bottles of akpeteshie and asked the seller to keep them for collection after two weeks.

When the buyer returned at Christmas time to collect the drinks, they were missing. He said the seller’s wife had mistakenly sold them to another person.

The buyer then sued for the cost of the drinks, which was ¢11. He won the case and was awarded ¢2 in costs.

He further stated that the buyer later reconsidered the matter and returned to court, saying the drinks had been intended as a Christmas gift for a friend in Gomoa Ekwamkrom and that he had suffered embarrassment due to the breach.

The buyer filed a second suit for damages for breach of contract and humiliation and was awarded ¢353 in damages.

The seller was dissatisfied and applied for a review of the judgment. The Magistrate who heard the matter, S.A. Brobbey—later a Supreme Court Justice—dismissed the review application.

The seller then appealed, and the case proceeded further, helping to explain key principles of the law of sale of goods.

Justice Srem Sai noted in his post that the case shows how, with a diligent lawyer, even two bottles of akpeteshie can contribute to the development of legal principles.

He added that Tsatsu Tsikata has set a high standard and described him as “one of a kind,” while also congratulating him.
